1. Acceptance of terms
By creating a Eliva account or using the Eliva application, you agree to these Terms of Service. If you do not agree, please do not use Eliva.
2. Description of service
Eliva is an AI-powered grocery shopping companion that compares prices across South African stores, assists with meal planning, tracks your budget, and provides personalised shopping guidance through an AI named Liv. Eliva is a companion tool — all purchasing decisions remain yours.
3. Account responsibility
You are responsible for maintaining the security of your account. You must not share your account credentials. You must be 13 years or older to use Eliva. You are responsible for all activity under your account.
4. Acceptable use
You may not use Eliva to violate any South African law, to harass other users or Eliva staff, to attempt to access systems beyond your account, to use automated tools to scrape or abuse the service, or to resell or sublicense access to Eliva.
5. Price accuracy
Eliva makes reasonable efforts to display accurate store prices. Prices are sourced from public data and may not reflect real-time store shelf prices. Eliva does not guarantee price accuracy and is not liable for any purchasing decisions made based on prices displayed in the app.
6. Subscriptions and billing
Premium and Family subscriptions are billed monthly or annually in South African rand via PayFast. You may cancel at any time. Cancellation takes effect at the end of the current billing period — no partial refunds are issued except where required by South African consumer law.
7. AI-generated content
Liv's responses are generated by artificial intelligence. While we strive for accuracy, AI can make mistakes. Do not rely solely on Liv's dietary, health, or financial guidance without exercising your own judgement. Eliva is not a licensed nutritionist, financial advisor, or medical professional.
8. Intellectual property
Eliva, Liv, the wordmark, and all app content are the property of Eliva (Pty) Ltd. You may not reproduce, distribute, or create derivative works without written permission.
9. Limitation of liability
To the extent permitted by South African law, Eliva is not liable for any indirect, incidental, or consequential damages arising from use of the service, including losses from pricing inaccuracies or reliance on Liv's advice.
10. Governing law
These terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of South Africa.
11. Changes to these terms
We may update these terms as Eliva evolves. We will notify you of material changes via email at least 14 days before they take effect. Continued use of Eliva after changes take effect constitutes acceptance.
